SUMMARY DEFINITION
Proactively oversees and facilitates problem-solving related to employee/employer relations issues, labor contract administration, grievance proceedings, and investigations involving employee behaviors, and work performance environment concerns. Provides leadership and centralized support for District-wide compliance with all requirements under Title IX and other federal and state anti-discrimination laws and matters pertaining to discrimination, harassment, and sexual violence. Serves as the District Title IX Coordinator and representative for Title IX related matters.
DISTINGUISHING CHARACTERISTICS
This position serves in a lead role in the Human Resources department and on the campuses. The primary areas of accountability include legal compliance, advocacy and education.
Serves as the main contact for employees, and complaints filed by students against employees, regarding Title IX compliance and requirements of federal, State, and local laws.
Serves as the on-site District HR management representative overseeing employee/employer relations issues at Irvine Valley College.
SUPERVISION RECEIVED AND EXERCISED
Receives direction from the Executive Director of Human Resources and Employee-Employer Relations or designee of the Vice Chancellor of Human Resources.
Exercises functional guidance over technical and clerical support personnel if assigned.
REPRESENTATIVE DUTIES
The following duties and responsibilities are typical for this position. Incumbents may not perform all the listed duties and/or may be required to perform additional or different duties from those set forth below to address business needs and changing business practices.
LEADERSHIP
- Oversees and conducts investigations and fact finding that are referred to District Human Resources from the campuses.
- Serves as a content expert related to Title IX compliance District-wide, and as the principal investigator for Title IX complaints involving employees of the District.
INVESTIGATIVE COMPLIANCE
- Receive, process, investigate and respond to complaints and grievances from employees, students, and third parties regarding Title IX, discrimination, sexual harassment, employment contract violations, misconduct and other issues; develop investigation plans for each complaint.
- Notifies and interviews complainants, respondents, and witnesses.
- Conducts investigations or work with third party neutral fact finders to conduct investigations.
- Counsels' employees as appropriate; prepares recommendations for appropriate corrective action and issue factual findings and recommendations, as necessary.
- Prepares detailed documentation of investigation findings along with maintaining detailed logsof investigation-related activities. Summarizes conclusions drawn from investigations findings andprepares reports as needed to resolve complaints and/or employeemisconduct issues.
- Acts as an initial in-take for ADA/FEHA related claims from employees of the District when needed.
COMPLIANCE GUIDANCE
- Works with teams of leadership and employees to convey policies and best practices associated with positive work behaviors and diligence in reporting unusual and illegal acts occurring on College properties.
- Provides in-person training, coaching and technical assistance to all levels of supervisory responsibility including faculty for the standard steps required to properly document matters related to employeemisconduct and discipline.
- Provides support to litigation against the District. Assists with the District's response to interrogatories and discovery requests when needed. Identifies and compiles responsive documents and information and forwards to legal counsel for response. Represent the District in court, at hearings, and on related administrative, personnel and other committees and commissions as directed.
- Oversees and maintains up-to-date files on grievances, complaints, investigations, mediations, and arbitrations, along with other ongoing employee/employer relations cases.
- Coordinates, and conducts training on ‘best' performance management practices, styles of leadership, contract compliance, conflict resolution, and other topics. Provide recommendations for training as well as changes to policies and procedures.
POLICY, PROCEDURES, AND ADMINISTRATIVE REQUIREMENTS
- Oversees administration of the laws and policies and conduct investigations for compliance with equal employment opportunity, affirmative action, ADA and access, Titles 5 and IX, ethics, employee complaints, and contract grievances.
- Establishes andmaintains processes and standards forinvestigations that arebased on ‘best' practices. Oversees investigation progress and intervenes in accordancewith establishedstandards and policies.
- Maintains up-to-date knowledge of trends and legislation relating to employee relations. Participates in developing, communicating, and implementing personnel policies and procedures. Uses research on state and national legislation to identify and recommend modified and new policies.
- Tracks, using the District's information systems, EEO, Title IX, Title 5, DFEH, and other forms or complaints governed by federal, state laws.
RELATIONSHIPS
- Ensure that all members of the District community are aware of their rights and obligations, including collaborating with the Office of the Vice President for Student Services at both colleges and other District departments, as needed, to ensure a prompt response and investigation of complaints and to ensure that students are aware of their options and resources with respect to reporting and filing complaints.
- Advises and assures administrators and supervisors get assistance in matters concerning the conflict resolution,employee-initiated complaints and grievances, discipline, fitness for duty, layoffs, and other issues impacting employer-employee relations.
- Leads and participates in avarietyof meetings that involve a rangeof human resourcetopics ranging from facilitating positive and productive work environments, planning processes, and conveys information relating to policy and employmentlaw; participates in the President's Manager meetings.
- Participates in and may coordinate departmental projects ranging from process improvement, training on leadership styles, preventative processes for mitigating complaints, to change management.
Performs other duties as assigned that support the overall objective of the position.

EDUCATION AND EXPERIENCE
Any combination of education and experience that would likely provide the required knowledge and abilities is qualifying. A typical way to obtain the knowledge and abilities would be:
Education :
The position requires a Bachelor's degree from an accredited college or university with major course work in human resources management, business or public administration, pre-law, or an equivalent discipline.
Juris Doctorate degree is highly desirable.
Master's degree or equivalent in Human Resources, Public Administration field directly related to the major responsibilities of the position, from an accredited institution is desirable.
Experience :
At least four years of work experience in employee/labor relations, training and investigation/resolution of discrimination and harassment complaints, in a public education setting, including at least two years of increasingly responsible legal compliance work or equivalent area. Certification as an investigator by the Association of Workplace Investigators is desirable.
LICENSES AND OTHER REQUIREMENTS
Valid California driver's license.

Work Environment :
Standard office setting. Typically, duties are performed in an office environment while sitting at a desk or computer workstation. Incumbents are subject to contact with others, frequent interruptions, noise from talking or office equipment and demanding legal timelines. At least minimal environmental controls to assure health and comfort. Must be able to adapt to changing situations and demanding timelines.
Physical Demands :
Incumbents regularly sit for long periods, walk short distances on a regular basis, travel to various locations to attend meetings and conduct work, use hands and fingers to operate an electronic keyboard or other office machines, reach with hands and arms, stoop or kneel or crouch to file, speak clearly and distinctly to answer telephones and to provide information; see to read fine print and operate computer; hear and understand voices over the telephone and in person; and lift, carry, and/or move objects weighing up to 10 pounds.
